March 28, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that Aaron George (DOB 02/08/95) of 396 Main St., White Plains, NY pled guilty before Judge Barry Warhit to:

  • one count of Murder in the Second Degree, a class “A” Felony,
  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Felony

in the shooting death of Dominique Hospie.  

On Sunday, April 17, 2016 at approximately 11:24 a.m. in the area of 91 North Kensico Ave. in White Plains, the defendant, along with co-defendant Michael Djukic, was in a Chrysler Pacifica driven by Djukic. They drove to the above-mentioned location.

Once there, co-defendant Djukic waited in the vehicle as defendant George exited the vehicle, approached the victim who was on Kensico Avenue and fired a handgun multiple times at him, striking the victim. Defendant George then ran back to and re-entered the vehicle where co-defendant Djukic was waiting in the driver’s seat and the two immediately drove off.  

The victim was taken to Westchester Medical Center suffering gunshot wounds to the hand and back. He later died in surgery.

The defendant’s remand continues

He will be sentenced on July 12, 2017.

The defendant faces an indeterminate sentence of imprisonment, the maximum term must be life, and the minimum term may be not less than 15 years nor more than 25 years. Thus, the minimum sentence is 15 years to life, and the maximum sentence is 25 years to life.

On May 18, 2016, co-defendant Michael Djukic (DOB 08/25/95) of 25 Lake St., White Plains, NY, was arraigned on an indictment charging him with:

  • one count of Criminal Possession of a Weapon in the Second Degree, a class “C” Felony,
  • one count of Criminal Facilitation in the Second Degree, a class “C” Felony,
  • one count of Tampering With Physical Evidence, a class “E” Felony,
  • one count of Hindering Prosecution in the Second Degree, a class “E” Felony.

Deputy Bureau Chief Nadine Nagler of the Career Criminal Division is prosecuting the case.

March 28, 2017 -- Westchester County District Attorney Anthony A. Scarpino Jr., announced today that Juan Sumba Duchi (DOB 04/08/84) of 22 Beech St., Greenburgh, NY was found guilty by a jury of:

 

  • one count of Attempted Rape in the First Degree, a class “C” Felony,
  • one count of Assault in the Second Degree, a class “D” Felony,
  • one count of Assault in the Third Degree, a class “A” Misdemeanor.

 

On or about Dec. 22, 2015, at approximately 10:00 p.m., the defendant drove his ex-girlfriend, in his vehicle to an isolated parking lot located at 228 Fisher Ave., in the City of White Plains.

Once in the parking lot, the defendant demanded that the victim have sex with him. When the victim refused and begged the defendant to take her home, the defendant became enraged and attacked her, breaking her nose and then attempting to rape her in the car. The victim fought the defendant off and managed to get out from under him escaping from the vehicle.   

The defendant then set upon the victim again, kicking and punching her while she lay on the ground. While the defendant stomped on her, he broke her collarbone.  A passerby heard the victim’s screams and called 911. Two other people who were in the vicinity came to the victim’s aid and pulled the defendant off of her. The police arrived within minutes and the defendant was apprehended at the scene.  

His remand continues.   

He will be sentenced on May 23, 2017.

Duchi faces a possible maximum sentence of fifteen years on the attempted rape conviction and seven years on the assault conviction.

March 28, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that Issac Esau Jara (DOB 04/07/87) of 129 State St., Ossining, NY was arraigned on a Felony Complaint in the Town Of Ossining Justice Court and charged with:

  • Four counts of Promoting An Obscene Sexual Performance By A Child, class “D” Felonies,
  • One count of Possessing An Obscene Sexual Performance By A Child, a class “E” Felony.

This morning investigators of the Westchester County District Attorney’s Office High Technology Crime Bureau arrested the defendant at his home in Ossining.

The first four counts of the current felony complaint concern the defendant uploading images to ChatStep, a free public group-chat and media sharing service, on Dec. 19, 2016 and March 28, 2017. The images depicted female children, from infant age up to prepubescence, being exposed in sexually obscene positions.  ChatStep then reported the images to the National Center for Missing and Exploited Children (NCMEC). 

NCMEC then forwarded the information to the New York State Internet Crimes Against Children Task Force.  As a result, a search warrant was executed at the defendant’s residence this morning.

During the search warrant, investigators also seized a computer device which contained an additional image containing an obscene sexual performance by a child. This image is contained in count five of the felony complaint.

The first upload associated with today’s arrest was approximately one month after the defendant’s release from federal custody.  On or about October 22, 2014, Isaac Jara was sentenced in Federal Court for the Southern District of New York for possession of child pornography.  The defendant received 366 days in federal custody and five years of supervised release.  He was released from federal custody in Nov. 17, 2015 and is currently on federal probation.

That conviction stemmed from downloads of child pornography from the defendant by both the FBI and the New York State Police. 

On or about Feb. 7, 2017, Jara was certified a Level 2 sex offender.  The defendant is now a predicate felon and can face up to seven years in state prison on each count.  He can also be charged federally on this case as a predicate sexual offender and have federal violation of supervised release charges. 

The defendant is remanded.

His next court date is April 11, 2017.

This case is being prosecuted by Assistant District Attorney Laura Forbes of the High Technology Crime Bureau.

March 28, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that  Deasia Bartee (DOB 01/09/90) of 210 Washington St., Mount Vernon, NY was sentenced to nineteen years in state prison by Judge Barbara Zambelli after having pled guilty to:  

  • one count of Manslaughter in the First Degree, a class “B” Felony

in the death of Samia Yusuf (DOB 05/24/15).

On Aug. 5, 2016 at approximately 5:21 a.m., a 911 call was received by the City of Mount Vernon Police Department for an unresponsive child who had died in her sleep.

The officers responded to 210 Washington St. where they found the victim, fourteen-and-half-month-old Samia Yusuf in a play pen. She was on her back with her arms rigid pointing towards the ceiling. Her left eye appeared to be swollen shut. The victim had no pulse and was lifeless. She was extremely cold to the touch.

The victim was taken to Mount Vernon Hospital and pronounced dead on arrival. The ER doctor who examined her told the police that the child was unusually cold and stated his belief the child had been dead for some time and may have been refrigerated as she was in an advanced state of decomposition.

The defendant, who was interviewed by detectives, implicated herself in the death of her child. She stated that she repeatedly struck the victim on the back with her hand. She was placed under arrest.

An autopsy conducted by the Medical Examiner’s Office ruled the victim’s cause of death as blunt force trauma of the body with a fracture dislocation of the lumbar spine and internal bleeding. Samia Yusuf was significantly underweight and malnourished and although fourteen and a half months old at the time of her death, weighed only fourteen pounds.  

Defendant was remanded into the custody of the New York State Department of Corrections.

March 21, 2017 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced today that David Carlson (DOB 04/28/71) of 99 Old Plank Road, Sparrowbush, NY was sentenced by Orange County Court Judge Robert Freehill to five years in state prison after having been convicted by a jury of:

  • one count of Manslaughter in the First Degree, a class “B” Felony,

relating to the death of Norris Acosta Sanchez.

The defendant was remanded into the custody of the New York State Department of Corrections.
