March 20, 2018 -- Westchester County District Attorney Anthony A. Scarpino, Jr. announced that Sincere Smith (DOB 05/10/95) pleaded guilty Monday to Robbery in the First Degree, a class B felony, for a robbery that took place in the Village of Ossining Feb. 12, 2017. He is scheduled to be sentenced June 13, 2018, and faces up to 25 years in prison. Smith, of New Rochelle, is currently in custody in Westchester County awaiting sentencing.
Earlier, Smith was convicted of Assault in the Second Degree, a class D felony, Feb. 28, 2018, after a weeklong trial regarding an incident May 13, 2017, at a Main Street New Rochelle barber shop where he and another man pistol whipped a victim. On Feb. 2, 2018, Smith’s co-defendant, Philip Sutton, pleaded guilty to Assault in the Second Degree for the same incident. Sutton admitted to acting in concert with Smith.
Smith is also charged along with co-defendants Eric Lee, Allen Copeland and Leroy Garcia with the murder of Trevon Boswell in Mount Vernon which took place during a 12-hour violent crime spree that occurred May 22, 2017. Smith faces up to 25 years to life in prison if he is convicted on this 50-count indictment which is currently pending. Smith is scheduled to appear in court on this indictment April 12, 2018.
The case is being prosecuted by Assistant District Attorneys Lauren Abinanti and Brian Bendish.
